An uncle and his nephew attacked a man with broom handles after he had repeatedly banged on the window at a takeaway shop, in Great Yarmouth, a court heard.

Yunus Arapoglu, 32 and his nephew, Ridvan Arapoglu, 18 had been inside the takeaway shop in St Peter's Road in the early hours of the morning when the victim started banging on the window with his belt.

Norwich Crown Court heard that the two men came out from the takeaway and beat the victim with broom handles. When police arrived the victim was taken to hospital, but did not want to make a complaint.

Chris Youell, prosecuting, said that the victim had also returned a few days later to the takeaway to apologise for his behaviour.

Yunus Arapoglu of Oxorough Walk, Great Yarmouth, and Ridvan Arapoglu, of St Peter's Road, Yarmouth, both admitted affray on June 26, last year.

Yunus was given a four month jail sentence suspended for 18 months and Ridvan was given four months youth custody suspended for four months. Both were also ordered to do 200 hours unpaid work.

Recorder Alastair Wilson told them it had been a sustained attack and it had continued after the victim was knocked to the ground but he said: “In this particular case there was very considerable provocation.”

Danielle O'Donovan, defending both men said the incident was out of character but they had been provoked.

She said that Ridvan was only 17 at the time of the offence.

She said that Yunus had six month old twins and one had a heart condition, which meant frequent emergency trips to hospital which would make doing unpaid work particularly difficult.
